The new ruling set out to bring law enforcement actions against fraudulent business opportunities two laws, the Franchise Rule and the FTC Act.  Neither was specifically designed for the unique frauds that occur frequently with business opportunities, yet grew into it.  The FTC has brought numerous enforcement actions against business opportunities using the Franchise Rules and even more cases against work-at-home and multilevel marketing companies under Section 5 of the FTC Act.

The Commission has conducted over 22 known sweeps on business opportunities with the new rulings.  The rule covers business opportunities commonly touted by fraudsters, while minimizing costs for legitimate businesses.
